SMS Compliance Policy

This SMS Compliance Policy (“Policy”) governs the use of all SMS/MMS messaging features within the RUNGP Platform, operated by Total Entertainment Media, LLC d/b/a RUNGP (“RUNGP,” “we,” “our,” or “us”).

This Policy is incorporated by reference into the RUNGP Terms of Service and complements the RUNGP Privacy Notice. By using RUNGP’s SMS/MMS capabilities, you agree to comply with this Policy.


1. Overview

RUNGP provides software tools for SMS/MMS messaging, marketing automation, and contact management. You, the customer (“Customer,” “User,” or “Account Owner”), are solely responsible for all messages sent using the Platform.

RUNGP does not: - Originate messages - Select recipients - Provide messaging content - Determine the purpose of any campaign.

You are the sender, marketer, and data controller of all outbound SMS/MMS communications.


2. Compliance with Laws & Industry Guidelines

You agree to comply with all applicable laws and regulations, including but not limited to:

a. TCPA (Telephone Consumer Protection Act)

  • Requires prior express consent for SMS/MMS messages

  • Requires opt-in before marketing messages

  • Requires honoring opt-outs immediately

b. CTIA Messaging Principles & Best Practices

  • Accurate sender identification

  • Clear opt-in disclosures

  • Respecting frequency & content guidelines

  • No SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco)

c. A2P 10DLC Compliance (Carrier Regulations)

  • Accurate campaign registration

  • Approved use cases

  • Valid sample messages

  • Adherence to carrier filtering policies

d. CAN-SPAM (for SMS where applicable)

  • Accurate sender identity

  • No deceptive content

e. State-Level Privacy & Messaging Regulations

Including but not limited to: - California - Florida - Washington - Oklahoma - Colorado

You are responsible for staying informed about all applicable laws.


3. Consent Requirements

a. Prior Express Consent

You must obtain valid opt-in consent before sending SMS messages. Acceptable consent methods include: - Web forms with checkbox consent - Keyword opt-in (“Text RUNGP to 12345”) - In-person signup (documented) - Event registration forms - Point-of-sale opt-ins.

b. Documentation

You must maintain records of: - Who opted in - How and when they opted in - The disclosure shown to them

RUNGP may request proof of consent in the event of carrier audits or legal inquiries.

c. No Third-Party Purchased Lists

You may not upload or message purchased, rented, scraped, or third‑party lists.


4. Required Opt-In Disclosures

Your opt-in language must clearly state: - What the subscriber is signing up for - The message frequency (“recurring messages”) - “Message & data rates may apply” - Instructions for HELP & STOP keywords - A link to your Privacy Notice and Terms

Example compliant disclosure: “By subscribing, you agree to receive recurring SMS messages from RUNGP. Message & data rates may apply. Reply STOP to cancel, HELP for help. View Terms & Privacy Policy.”


5. Opt-Out Requirements

You must: - Process STOP/UNSUBSCRIBE requests immediately - Ensure opt-out flows work at all times - Not send additional marketing after an opt-out - Maintain suppression lists.

Supported opt-out keywords include: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT.


6. Message Content Restrictions (CTIA)

The following content is prohibited: - SHAFT: Sex, Hate, Alcohol (unless age-gated), Firearms, Tobacco - Illegal drugs or paraphernalia - Profanity, threats, harassment - Deceptive or fraudulent solicitations - Loan, debt relief, or other restricted categories - SHAFT-adjacent or sensitive political content.

RUNGP may suspend accounts violating these restrictions.


7. A2P 10DLC Registration Requirements

You must provide accurate and complete information for: - Brand registration - Use-case selection - Campaign descriptions - Sample messages - Website URLs.

Misrepresentation can result in: - Carrier rejection - Increased filtering - Account suspension.


8. Message Sending Requirements

You agree to: - Send messages only during appropriate hours (e.g., 8am–9pm local time) - Identify your brand in the message - Honor frequency limits - Ensure routing accuracy - Avoid snowshoeing (sending across multiple numbers to evade filters).


9. Prohibited Behaviors

You may not: - Send unsolicited messages - Send without consent - Send high-risk content - Send misleading or deceptive messages - Send excessively frequent messages - Evade carrier filtering - Impersonate other brands or individuals.


10. Responsibility for Contact Data

You are responsible for: - Uploading only compliant contacts - Maintaining accurate and lawful contact records - Honoring data subject requests - Ensuring your privacy notice discloses SMS practices.

RUNGP is not responsible for: - Your messaging content - Contact list quality - Your compliance failures - Legal outcomes or audits involving your messages.


11. Monitoring & Enforcement

RUNGP may monitor messaging activity to: - Detect spam or abuse - Detect high-risk content - Address carrier complaints - Enforce compliance

RUNGP reserves the right to: - Block messages - Suspend sending - Require proof of consent - Terminate accounts engaging in violations.


12. AI-Generated SMS Content

If you use RUNGP’s AI tools to create message templates: - You must manually review all content - You are responsible for legal compliance - AI outputs may be inaccurate or incomplete.

RUNGP is not liable for SMS sent using AI-generated content.


13. Fees, Penalties & Carrier Charges

You are responsible for: - All messaging fees - Carrier surcharges - Penalties resulting from violations - Increased fees due to registration failures or filtering.

RUNGP is not liable for fees imposed by carriers.


14. Complaints & Investigations

If RUNGP receives: - Spam complaints - Carrier violation notices - Legal claims - Regulatory inquiries.

You must provide: - Proof of consent - Opt-in records - Campaign details - Message samples.

Failure to comply may lead to suspension or termination.


15. Changes to This Policy

RUNGP may update this Policy at any time. Continued use of SMS features constitutes acceptance.
